This website is owned and operated by Vitis Renaissance Tours LLC, doing business as Vitis Adventures. These terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors the option to buy a single event wine class. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

Who Can Use This Website and/or Our Services
In order to use our website and/or receive our services, you must be at least the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

When buying a class, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

Retention of Right to Change Offering.
We may, without prior notice, change the services, stop providing the services, or any feature of the services we offer, or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Cancellation Policy.
Please contact us at least 48 hours in advance to cancel your booking and receive a 100% refund, minus a processing fee of 20% of the booking total. We are happy to discuss rescheduling as an alternative.
Less than 48 hours notice of cancellation will be offered the opportunity to reschedule or a 25% refund.
Less than 24 hours notice will be charged the full amount.
Canceling a rescheduled booking will be offered the opportunity to reschedule again or a 25% refund.

Ownership of Intellectual Property, Copyrights, and Logos.
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Vitis Renaissance Tours LLC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

Indemnification
You agree to indemnify and hold Vitis Adventures or Vitis Renaissance Tours harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Limitation of Liability
To the maximum extent permitted by applicable law, Vitis Adventures and Vitis Renaissance Tours LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to Modify Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. When we change the terms in a material manner, we will notify you that material changes have been made to the terms. Your continued use of the website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Alcohol Policy
Although we do not provide any alcohol, if you choose to consume any during the class, you accept that you are solely responsible for establishing the age of your guests, monitoring the quantity of alcohol that you and your guests consume, and understand that neither Vitis Renaissance or Vitis Adventures will be held responsible or liable for you or your guests consuming any alcohol, or any damage, illness, liability, or expense that may result from that consumption to yourself or others. You understand that Vitis Adventures can and will bring the class to an end, at your expense, should your behavior hamper the execution of the class, and that no refund will be issued.

Authorization to Use Photographs and/or Audio-Visual.
Vitis Renaissance Tours may use, reproduce, and/or publish photographs and/or video that may pertain to me— including my image, likeness, and/or voice without compensation. I understand that this material may be used in brochures, e-mails, and online to promote Vitis Renaissance Tours and its product offerings.

Arbitration
Any controversy or claim arising out of or relating to this agreement, whether or not specifically addressed herein, shall be settled by binding arbitration in Seattle, WA, USA, in accordance with the rules of the American Arbitration Association. This agreement to arbitrate does not waive or modify the liability release contained in this document. The Superior Court of Washington for King County in Seattle, WA, shall have exclusive venue and jurisdiction over all parties in enforcing the terms and requirements of this release, including the enforcement of any arbitration award.

Waiver of Jury Trial.
In connection with any action or legal proceeding arising out of this agreement, the parties hereby specifically and knowingly waive any rights that either party might have to demand a jury trial.

Release.
You acknowledge that you have had the opportunity to carefully read through these terms and conditions and have them reviewed by an attorney. In consideration of the services and arrangements provided by Vitis Renaissance LLC doing business as Vitis Adventures, and subject to such acknowledgement, you, including but not limited to, your heirs, successors, assigns, beneficiaries, agents and legal representatives, do hereby release, hold harmless and indemnify Vitis Renaissance Tours and Vitis Adventures, its owners, officers, directors, agents, employees, contractors, subcontractors and affiliates from any and all claims, liability, or losses for bodily injury, emotional injury or distress, property loss, damage or death which may arise from your participation in any Vitis Adventures class or event. This release shall be legally interpreted to the fullest extent permissible and, should any part be held invalid, it is agreed that all other parts shall continue in full legal force and effect. You fully understand and agree to the contents and legal terms of this release. You understand that it is a legally binding contract and you are signing it of your own free will.
